		<description>More than a year ago, before the chief justice and the superior judiciary were restored to their rightful positions though it is inevitable for the judiciary to assert itself in light of its much-needed newfound independence, in its quest to do so, it must not forget the essence of democracy. The onslaught by judiciary would undermine democracy. Mere blind decision to declare NRO void ab initio, would also raise some question? Nullifying NRO also puts Chief Justice’s position at stake and his appointment becomes void ab initio. First of all he was appointed by a dictator, which was totally unconstitutional, on the other hand Govt was elected through a democratic process. If we recall past role of Iftikhar Chaudhry, he was very much part of a larger bench headed by the then CJ Irshad Hassan Khan, which had validated the military takeover of General Musharraf on October 12. It said instead of resigning from the bench, the Supreme Court judges had validated the military takeover in the Zafar Ali Shah case (PLD 2000SC 860). In the Zafar Ali Shah case which still holds the field when filed, the Constitution was held in abeyance, but the then SC judges had not walked away from peculiar circumstances, but validated the rule of General Musharraf.
The other major flaw in the decision is that Judiciary wrongly interpreted the Islamic laws and intermingled it with personal interest. The first deal signed by the Holy prophet (PBUH) was the Charter of Madian, a very big example of reconciliatory process, but judiciary blindly ignored that. The purpose of NRO was the same as that is reconciliation and that was achieved. Ignoring this important fact shows that judiciary wants to push country back at square one.  The honorable judiciary also failed to mark out that during Musharraf’s dictatorial regime several political leaders with massive charges were exempted and granted pardon mere on simple applications. 
We beg to Chief justice not to put country back at square one where a dictator is seen with a beating stick, humiliating judges and forcing leaders to flee in Saudi Arabia. Pity the nation please.</description>
